Conditions of Advice

 

1) What does Port State Control (PSC) apply to?

PSC Applies to landings and/or transhipments in ports of NEAFC Contracting Parties (CPs) of frozen fish caught in the Convention Area (CA) by foreign fishing vessels.


2) Who are NEAFC CP's

EU, DNK(GRL, FRO), ISL, NOR, RUS


3) Where is the Convention Area (CA)?

East of 42º W meridian, west of 51º E meridian , north of 36º N parallel.


4) My vessel is from The Faroes (or Greenland or Iceland or Norway or Russia or EU) and I am landing frozen fish in my own country does PSC apply?

PSC will apply if any part of your catch has been transhipped from a donor vessel that is not from your country.


5) My vessel is from an EU member-State and I am landing my frozen fish in the port of another EU member State, does PSC apply?

PSC will apply if any part of your catch has been transhipped from a donor vessel that is from Faroes, Greenland , Iceland, Norway or Russia.


6) My vessel has transhipped fish from a donor vessel which is not from one of NEAFC's CPs, does PSC apply to this catch?

This is illegal.
(Exception applies to vessels flying the flag of a Cooperative Non-Contracting Party) You will not be able to land the catch and you risk having your vessel put on the NEAFC IUU BList.

7) Which are the designated ports & can I land frozen catch in any other ports?

You can not land your frozen catch in any other port.

You will be authorized to tranship in port but not land catch.

This advice has been written to sum up a part of the NEAFC "Scheme of Control and Enforcement". It must not be used as the basis for any decision. The "Scheme of Control and Enforcement" must be consulted. Commercial operators are required to deal directly with the Flag-state of their vessel in relation to these matters and seek any confirmation or advice from these officials. NEAFC can not be responsible for any misunderstanding of this advice.
